Your Rights Under Ohio's Workers Compensation Law

While the state of Ohio is an employment at-will state, making it acceptable for employers to terminate employees at any time, for any reason, there are some exceptions to this rule and one of them protects an employee who has filed for workers’ compensation benefits. It is against Ohio law to fire an employee for filing a workers compensation claim in retaliation for the worker filing a claim. Doing so is called a wrongful or retaliatory discharge. Additionally, a worker may not be demoted for filing a workers' compensation claim.

The law of wrongful termination in Ohio provides protection to employees and employers need to be very careful about what they do with employees who have filed legitimate Workers’ Compensation claims.
